General Terms and Conditions for Accommodation Contracts
(as of January 1, 2024)
1. Provider and scope
These booking conditions apply to all contracts for the temporary rental of holiday apartments, apartments, studios and holiday homes, as well as to all related services provided by:
Magnolia-Homes GmbH,
Sonnenhof 3,
CH-8280 Kreuzlingen
, Switzerland,
Phone: +41 79 260 50 40
, Email: info@magnolia-homes.ch,
Company number: CHE-110.232.759
Hereinafter referred to as "Magnolia Homes".
These terms and conditions apply in particular to bookings made via the Magnolia Homes website as well as to bookings made by telephone, email or via a booking link provided by Magnolia Homes.
For bookings made via external booking platforms such as Booking.com or Airbnb, the terms and conditions of the respective booking platform or the booked rate apply additionally and, in case of discrepancies, take precedence.
Individual agreements and expressly stated fare conditions take precedence over these general booking conditions.
2. Conclusion of the contract
The presentation of accommodation on the website does not constitute a binding offer to conclude an accommodation contract.
When booking via the website, the guest submits a binding booking offer upon completion of the booking process. The accommodation contract is concluded as soon as Magnolia Homes confirms the booking electronically or in writing.
A telephone booking becomes binding as soon as Magnolia Homes accepts the booking during the call and the guest has been informed of the essential booking details, the price, the payment terms, and the applicable cancellation policy. By making the telephone booking, the guest confirms that they have been informed of and accept the booking conditions. Magnolia Homes will then send the guest a booking confirmation by email or other written form.
The guest is obliged to provide complete and correct information about himself/herself, his/her contact details and the number of people traveling with him/her when making the booking.
The person making the booking must be at least 18 years old and legally competent. They are liable for the contractual obligations of all guests they register, insofar as they act as their representative or contractual partner.
3. Prices and Payment
The prices agreed upon at the time of booking and listed in the booking confirmation apply.
The total price may include, in particular, the accommodation price, final cleaning, booked additional services, taxes, and statutory charges. Tourist taxes or similar local charges may be shown and collected separately.
The payment terms and dates are specified in the booked rate and booking confirmation. Magnolia Homes reserves the right to request full or partial prepayment.
Unless a different payment date has been agreed upon, the full booking price must be paid no later than before arrival.
In the event of late payment, Magnolia Homes may request payment from the guest and, after a reasonable grace period has expired without payment, withdraw from the contract. The agreed cancellation policy and any further claims remain unaffected.
4. Arrival and Departure
The valid check-in and check-out times will be communicated in the booking confirmation or arrival information.
Early check-in or late check-out is only possible if explicitly confirmed. An additional fee may be charged for this.
Guests must inform Magnolia Homes in advance of any late arrival. A late arrival will not result in a reduction of the booking price.
The accommodation must be completely vacated and left in good order by the agreed check-out time on the day of departure. A reasonable usage fee and any resulting additional costs may be charged for late returns.
5. Use of the accommodation
The accommodation may only be used for lodging purposes and only by the persons named in the booking.
The stated maximum number of guests must not be exceeded. Unregistered overnight guests are only permitted with the prior consent of Magnolia Homes. Magnolia Homes may charge an additional fee or refuse to accommodate additional guests.
Subletting, further letting or transferring the property to unregistered third parties is not permitted without prior consent.
Parties, events, commercial photo or film productions, and other uses that go beyond ordinary residence require the prior consent of Magnolia Homes.
The guest agrees to comply with the house rules, quiet hours and official regulations, and to be considerate of other residents and neighbors.
Whether smoking or pets are allowed depends on the description of the respective accommodation, the booking confirmation and the house rules.
6. Online check-in and access
If a digital or official check-in is required, the guest and their fellow travelers must submit the necessary information completely and in a timely manner.
Magnolia Homes may withhold the release of door codes, keys or other access data until check-in is fully completed, legal reporting obligations have been fulfilled and any outstanding amounts have been paid.
Personal door codes, keys, and other access devices must not be given to unauthorized persons. Any loss or misuse must be reported to Magnolia Homes immediately.
7. Cancellation by the guest
Cancellations must be submitted to Magnolia Homes in writing, preferably by email. The date of receipt of the cancellation by Magnolia Homes is decisive.
A booking can be cancelled free of charge up to the end of the 15th calendar day before the agreed arrival date.
For cancellations made from the beginning of the 14th calendar day before the agreed arrival date, 100 percent of the agreed accommodation price for the entire booked stay will be charged.
The full payment obligation also applies in the following cases:
- No-show,
- delayed arrival,
- early departure,
- online check-in not completed or not completed in time, provided that Magnolia Homes has provided the necessary information in a timely manner,
- Refusal of entry due to a breach of contract attributable to the guest.
Payments already made will be offset against the cancellation fees owed and are generally not refundable.
Unpaid tourist taxes and separately billed additional services that were not provided will not be charged or will be refunded.
Magnolia Homes will make reasonable efforts to re-let the accommodation. Any income from re-letting for the same period will be credited against the cancellation fee after deduction of any additional costs incurred.
The guest retains the right to prove that Magnolia Homes suffered no damage or significantly less damage.
Personal reasons of the guest, in particular illness, accident, changes in travel plans, traffic disruptions as well as flight or train cancellations, do not exempt them from the agreed cancellation fees.
Magnolia Homes recommends taking out travel and cancellation insurance.
For fares expressly marked as non-refundable, the conditions communicated during the booking process or by telephone and listed in the booking confirmation apply.
8. Rebookings and changes
Rebookings and changes to a confirmed booking are only possible with the consent of Magnolia Homes.
If a requested change cannot be confirmed, the original booking, including the agreed payment obligations, remains in effect.
Price changes due to a rebooking, a change in length of stay or a change in the number of guests will be calculated accordingly.
A reduction in the length of stay after the free cancellation period has expired will be treated as a cancellation with regard to the nights not booked.
9. Alternative accommodation and cancellation by Magnolia Homes
If the booked accommodation cannot be provided for a reason attributable to Magnolia Homes, Magnolia Homes may offer equivalent or superior alternative accommodation.
If no suitable alternative accommodation can be offered, or if the guest does not accept an objectively non-equivalent alternative accommodation, the payments made for the unused overnight stays will be refunded.
Magnolia Homes may withdraw from the contract or terminate an already commenced stay for good cause. Good cause exists in particular if:
- Due payments are not made,
- false or misleading information was provided during the booking process,
- the accommodation is being used in breach of contract,
- the permitted number of guests is exceeded,
- other guests, residents or neighbors are significantly disturbed
- Violating the house rules or official regulations,
- There are concrete indications of unlawful use,
- The continuation of the contract is unacceptable for Magnolia Homes.
If the important reason is the guest's fault, there is generally no entitlement to a refund. Any expenses saved and income from renting the property to another party will be taken into account.
10. Force Majeure
If Magnolia Homes is unable to fulfill the contract due to force majeure or other circumstances beyond its control, Magnolia Homes may withdraw from the contract.
This includes, in particular, natural disasters, official orders, fires, floods, significant building damage, prolonged failures of essential services, or other events that make the safe use of the accommodation impossible.
Payments for unused overnight stays and additional services will be refunded. Further claims, in particular for travel expenses, alternative accommodation, or consequential costs, exist only within the framework of mandatory legal provisions.
11. Defects and complaints
The guest must report any recognizable defects, damage or missing equipment immediately upon arrival.
Any disturbances or defects occurring during the stay must also be reported immediately. The guest must give Magnolia Homes a reasonable opportunity to inspect and rectify the defect.
If the guest fails to report the issue in a timely manner and Magnolia Homes is therefore unable to remedy the situation, any resulting claims by the guest may be limited.
A complaint does not automatically entitle the guest to withhold payments or to independently book alternative accommodation at the expense of Magnolia Homes.
12. Duty of care and damages
The guest must treat the accommodation, its furnishings, common areas, and any keys and access devices provided with care.
Damage or loss must be reported immediately.
The guest is liable under the statutory provisions for damages caused culpably by him, his fellow travelers, visitors or persons to whom he has granted access.
Magnolia Homes may charge for documented costs of repairs, replacements, additional cleaning, key replacement, necessary emergency measures and any resulting loss of occupancy.
Normal wear and tear and pre-existing damage are not charged.
13. Cleaning
The accommodation must be left in a tidy condition. Dishes must be washed or loaded into the dishwasher. Waste must be disposed of according to the provided instructions.
The agreed final cleaning includes the usual cleaning after a stay in accordance with the contract.
In cases of exceptional soiling, traces of smoke, strong odors, undisclosed waste or excessive cleaning effort, the additional costs may be charged.
14. Liability of Magnolia Homes
Magnolia Homes is liable for damages caused intentionally or through gross negligence. Otherwise, liability is governed by mandatory legal provisions.
Magnolia Homes is only liable for personal belongings, cash, valuables, vehicles, bicycles or luggage within the scope of the statutory regulations.
Magnolia Homes is not liable for disruptions beyond its control. This includes, in particular, temporary outages of internet, electricity, water, heating, elevators, and public utilities and transport services, unless Magnolia Homes is at fault for causing these disruptions.
Information regarding distances, transport connections, parking facilities, restaurants, leisure activities and third-party services is provided to the best of our knowledge. No guarantee is given for their continued availability.
15. Internet access
Provided internet access may only be used within the framework of legal regulations.
The guest is responsible for all actions taken via the internet connection. Illegal downloads, copyright infringements, criminal content, and other unauthorized uses are prohibited.
A consistently uninterrupted connection or a specific transmission speed cannot be guaranteed.
16. Data protection
Personal data is processed for the purpose of handling the booking, carrying out the stay, fulfilling legal reporting obligations, processing payments and communicating with the guest.
Further information can be found in the privacy policy published on the website.
17. Final Provisions
Swiss law applies, unless mandatory legal provisions stipulate otherwise.
For accommodations outside of Switzerland, mandatory legal provisions at the location of the accommodation and mandatory consumer protection regulations remain reserved.
The place of jurisdiction is Kreuzlingen, Switzerland, to the extent permitted by law. Mandatory legal places of jurisdiction, in particular for consumers, remain reserved.
Should any provision of these booking conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The applicable statutory provisions shall apply in place of the invalid provision.
The version of these booking conditions agreed upon at the time of booking shall apply.

General Terms and Conditions for Accommodation Contracts
Last updated: January 1, 2024
1. Provider and scope
These Booking Terms and Conditions apply to all contracts concerning the temporary provision of holiday apartments, serviced apartments, studios and holiday homes and to all related services provided by:
Magnolia-Homes GmbH
Sonnenhof 3
CH-8280 Kreuzlingen
Switzerland
Telephone: +41 79 260 50 40
Email: info@magnolia-homes.ch
Company number: CHE-110.232.759
Hereafter referred to as “Magnolia Homes”.
These terms apply in particular to bookings made through the Magnolia Homes website, by telephone, by email or through a booking link provided by Magnolia Homes.
For bookings made through external booking platforms such as Booking.com or Airbnb, the terms displayed by the respective platform or for the selected rate apply in addition to these terms. In the event of any conflict, the terms expressly agreed upon through the booking platform shall take precedence.
Individual agreements and expressly stated rate conditions shall take precedence over these general booking terms and conditions.
2. Conclusion of the contract
The presentation of accommodation on the website does not constitute a binding offer to enter into an accommodation contract.
When booking through the website, the guest submits a binding booking request by completing the booking process. The accommodation contract becomes effective when Magnolia Homes confirms the booking electronically or in writing.
A telephone booking becomes binding when Magnolia Homes accepts the booking during the telephone conversation and the guest has been informed of the essential booking details, price, payment terms and applicable cancellation policy. By completing a telephone booking, the guest confirms that they have been informed of and accept these Booking Terms and Conditions. Magnolia Homes will subsequently send the guest a booking confirmation by email or in another text form.
The guest must provide complete and accurate personal details, contact information and details of all accompanying guests.
The person making the booking must be at least 18 years old and legally capable of entering into a contract. That person shall be responsible for the contractual obligations of all registered guests to the extent that they act as their representative or contractual partner.
3. Prices and payment
The prices agreed upon at the time of booking and stated in the booking confirmation shall apply.
The total price may include the accommodation price, final cleaning, additional services, taxes and statutory charges. Tourist taxes or comparable local charges may be shown and collected separately.
The applicable payment terms and due dates are specified in the selected rate and booking confirmation. Magnolia Homes may require full or partial advance payment.
Unless another payment date has been agreed, the full booking price must be paid no later than before arrival.
If payment is not made on time, Magnolia Homes may request payment and, after the unsuccessful expiry of a reasonable additional payment period, withdraw from the contract. The agreed cancellation policy and any further legal claims remain unaffected.
4. Arrival and departure
The applicable check-in and check-out times will be stated in the booking confirmation or arrival information.
The guest is not entitled to an early check-in or late check-out unless expressly confirmed by Magnolia Homes. An additional fee may be charged for these services.
Guests expecting to arrive late must inform Magnolia Homes in good time. Late arrival does not result in a reduction of the booking price.
The accommodation must be completely vacated and left in an orderly condition by the agreed check-out time. In the event of a late departure, Magnolia Homes may charge reasonable compensation for continued use and any resulting additional costs.
5. Use of the accommodation
The accommodation may only be used for accommodation purposes and only by the persons stated in the booking.
The maximum number of permitted occupants may not be exceeded. Unregistered overnight guests require the prior approval of Magnolia Homes. Magnolia Homes may charge an additional fee or refuse to accommodate additional guests.
Subletting, reselling or transferring the accommodation to unregistered third parties is not permitted without prior approval.
Parties, events, commercial photography or filming and any use beyond an ordinary stay require the prior approval of Magnolia Homes.
The guest must comply with the applicable house rules, quiet hours and official regulations and must show consideration for other residents and neighbors.
Whether smoking or pets are permitted is governed by the description of the relevant accommodation, the booking confirmation and the applicable house rules.
6. Online check-in and access
Where digital or legally required guest registration is provided, the guest and all accompanying guests must submit the required information completely and on time.
Magnolia Homes may withhold door codes, keys or other access details until the check-in process and legally required guest registration have been completed and all outstanding amounts have been paid.
Personal door codes, keys and other access credentials must not be passed on to unauthorized persons. Any loss or suspected misuse must be reported to Magnolia Homes immediately.
7. Cancellation by the guest
Cancellations must be communicated to Magnolia Homes in text form, in particular by email. The time at which Magnolia Homes receives the cancellation is decisive.
A booking may be canceled free of charge until the end of the 15th calendar day before the agreed arrival date.
For cancellations received from the beginning of the 14th calendar day before the agreed arrival date, 100% of the agreed accommodation price for the entire booked stay will be charged.
The full accommodation price will also be payable in the event of:
- failure to arrive (“no-show”);
- late arrival;
- early departure;
- failure to complete the required online check-in on time, provided Magnolia Homes supplied the necessary information in good time;
- Refusal of access due to a breach of contract for which the guest is responsible.
Payments already made will be applied against the cancellation charges and will generally not be refunded.
Tourist taxes that are not incurred and separately charged additional services that are not provided will not be charged or will be refunded.
Magnolia Homes will make reasonable efforts to re-let the accommodation. Revenue received from re-letting the same accommodation for the same period will be credited against the cancellation charge after deduction of any additional costs incurred.
The guest may provide evidence that Magnolia Homes suffered no loss or a substantially lower loss.
Personal circumstances of the guest, including illness, accident, changes to travel plans, traffic disruption and canceled or delayed flights or trains, do not release the guest from the agreed cancellation charges.
Magnolia Homes recommends taking out appropriate travel and cancellation insurance.
For rates expressly marked as non-refundable, the conditions communicated during the online or telephone booking and stated in the booking confirmation shall apply.
8. Rebooking and booking changes
Changes to a confirmed booking are only possible with the approval of Magnolia Homes.
If the requested change cannot be confirmed, the original booking and the associated payment obligations remain in force.
Any price difference resulting from a change of dates, length of stay or number of guests will be charged accordingly.
A reduction in the length of stay after the free cancellation period has expired will be treated as a cancellation of the unused nights.
9. Alternative accommodation and termination by Magnolia Homes
If the booked accommodation cannot be provided for a reason attributable to Magnolia Homes, Magnolia Homes may offer equivalent or higher-category alternative accommodation.
If suitable alternative accommodation cannot be provided, or if the guest rejects alternative accommodation that is objectively not equivalent, payments made for accommodation that has not been provided will be refunded.
Magnolia Homes may withdraw from the contract or terminate an ongoing stay for good cause. Good cause includes, in particular, situations where:
- payments due have not been made;
- false or misleading information was provided;
- the accommodation is used in breach of the contract;
- the permitted number of guests is exceeded;
- other guests, residents or neighbors are seriously disturbed;
- the house rules or official regulations are breached;
- there are reasonable grounds to suspect unlawful use;
- continuing the contract would be unreasonable for Magnolia Homes.
If the guest is responsible for the termination, the guest will generally not be entitled to a refund. Expenses saved and income received from re-letting the accommodation will be credited.
10. Force majeure
Magnolia Homes may withdraw from the contract if it is unable to provide the accommodation due to force majeure or other circumstances beyond its reasonable control.
Such circumstances include natural events, official orders, fire, flooding, serious building damage, prolonged failure of essential utilities or other events that make the safe use of the accommodation impossible.
Payments for accommodation and additional services not provided will be refunded. Further claims, including claims for travel expenses, alternative accommodation or consequential losses, shall only exist where required by mandatory law.
11. Defects and complaints
The guest must report visible defects, damage or missing items immediately upon arrival.
Any issue or defect arising during the stay must also be reported without delay. The guest must give Magnolia Homes a reasonable opportunity to inspect and remedy the issue.
If the guest fails to report a defect in good time and Magnolia Homes is consequently unable to remedy it, any resulting claims by the guest may be limited.
A complaint does not automatically entitle the guest to withhold payment or arrange alternative accommodation at the expense of Magnolia Homes.
12. Duty of care and damage
The guest must treat the accommodation, its furnishings, communal areas, keys and access credentials with reasonable care.
Damage or loss must be reported immediately.
In accordance with applicable law, the guest is liable for damage culpably caused by the guest, accompanying guests, visitors or any person to whom the guest has granted access.
Magnolia Homes may charge documented costs for repairs, replacement items, additional cleaning, replacement keys, necessary emergency measures and any resulting loss of occupancy.
Normal wear and tear and damage that existed before the guest's arrival will not be charged.
13. Cleaning
The accommodation must be left in an orderly condition. Dishes must be washed or placed in the dishwasher. Waste must be disposed of in accordance with the instructions provided.
The agreed final cleaning fee covers normal cleaning following proper use of the accommodation.
Additional cleaning costs may be charged in the event of exceptional dirt, smoke residue, strong odors, undisposed waste or cleaning requirements that substantially exceed normal use.
14. Liability of Magnolia Homes
Magnolia Homes is liable for damage caused intentionally or through gross negligence. In all other respects, liability is governed by mandatory statutory provisions.
Magnolia Homes is only liable for personal belongings, cash, valuables, vehicles, bicycles or luggage within the limits of applicable law.
Magnolia Homes is not liable for disruptions outside its control. These include temporary interruptions to internet, electricity, water, heating, lifts, public utilities or transport services, unless Magnolia Homes culpably caused the interruption.
Information regarding distances, transport connections, parking, restaurants, leisure activities and third-party services is provided to the best of Magnolia Homes' knowledge. Their continued availability cannot be guaranteed.
15. Internet access
Any internet access provided may only be used in accordance with applicable law.
The guest is responsible for activities performed through the connection. Illegal downloads, copyright infringement, criminal content and other unlawful use are prohibited.
Magnolia Homes cannot guarantee uninterrupted availability or a particular internet speed.
16. Data protection
Personal data is processed for booking administration, performance of the accommodation contract, compliance with statutory registration obligations, payment processing and communication with the guest.
Further information is available in the Privacy Policy published on the Magnolia Homes website.
17. Final provisions
Swiss law shall apply unless mandatory legal provisions require otherwise.
For accommodation located outside Switzerland, mandatory laws applicable at the location of the accommodation and mandatory consumer protection provisions remain reserved.
To the extent permitted by law, the place of jurisdiction shall be Kreuzlingen, Switzerland. Mandatory statutory places of jurisdiction, particularly those protecting consumers, remain unaffected.
If any provision of these Booking Terms and Conditions is or becomes wholly or partly invalid, the validity of the remaining provisions shall not be affected. The applicable statutory rules shall replace the invalid provision.
The version of these Booking Terms and Conditions agreed upon at the time of booking shall apply.
